b) Right of access

Each data subject shall have the right granted by the European legislator to obtain from the controller free information about his or her personal data stored at any time and a copy of this information. Furthermore, the European directives and regulations grant the data subject access to the following information:

• the purposes of the processing;
• the categories of personal data concerned;
• the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
• where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
• the existence of the right to request from the controller rectification or erasure of personal data, or restriction of processing of personal data concerning the data subject, or to object to such processing;
• the existence of the right to lodge a complaint with a supervisory authority;
• where the personal data are not collected from the data subject, any available information as to their source;
• the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject.

Furthermore, the data subject shall have a right to obtain information as to whether personal data are transferred to a third country or to an international organisation. d) Right to erasure (Right to be forgotten)

Each data subject shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary:

• The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
• The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.
• The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
• The personal data have been unlawfully processed.
• The personal data must be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
• The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the Petite Genève Petrović, he or she may, at any time, contact any employee of the controller. Profilisanje podrazumeva bilo koji oblik automatske obrade ličnih podataka koji se sastoji od korišćenja ličnih podataka za vrednovanje određenih ličnih aspekata koji se odnose na fizičku osobu, posebno za analizu i predviđanje aspekata u pogledu učinka tog fizičkog lica na poslu, ekonomske situacije, zdravlja, ličnih preferenci, interesa, pouzdanosti, ponašanja, lokacije ili kretanja.

f) Pseudonimizacija

Pseudonimizacija je obrada ličnih podataka na način na koji lični podaci više ne mogu biti pripisani određenom subjektu podataka bez upotrebe dodatnih informacija, pod uslovom da se takve dodatne informacije čuvaju odvojeno i podležu tehničkim i organizacionim merama kako bi se osiguralo da se lični podaci ne pripisuju identifikovanoj fizičkoj osobi.

g) Kontrolor zadužen za obradu

Kontrolor zadužen za obradu je fizičko ili pravno lice, javni organ, agencija ili drugo telo koje, samo, ili udruženo sa ostalima, određuje svrhu i načine obrade ličnih podataka; gde su svrha i sredstva takve obrade određeni zakonom Unije ili države članica, kontrolor ili posebni kriterijumi za tu nominaciju mogu biti obezbeđeni zakonom Unije ili države članica.

h) Procesor

Procesor je fizičko ili pravno lice, javni organ, agencija ili drugo telo koje obrađuje lične podatke u ime kontrolora.

i) Primalac

Primalac je fizičko ili pravno lice, javni organ, agencija ili drugo telo kojoj su lični podaci obelodanjeni, bilo da je u pitanju treće lice ili ne. Međutim, javne nadležnosti koje mogu dobiti lične podatke u okviru posebne istrage u skladu sa zakonom Unije ili države članice neće se posmatrati kao primaoci; obrada tih podataka od strane tih javnih nadležnosti će biti u skladu sa postojećim pravilima začtite podataka i u skladu sa svrhom obrade.

j) Treće lice

Treće lice može biti fizičko ili pravno lice, javni organ, agencija ili telo koje nije subjekat, kontrolor, procesor ili osoba koja, pod direktnim autoritetom kontrolora ili procesora, može biti autorizovana da izvrši obradu ličnih podataka.

k) Pristanak

Pristanak subjekta je bilo kakva slobodno data, specifična, informisana i nedvosmislena indikacija želje subjekta prema kojoj on ili ona, putem izjave ili jasne afirmativne akcije, označava pristanak na obradu ličnih podataka koje se odnose na nju ili njega.

Subjekt može, u bilo kom trenutku, kontaktirati našeg službenika za zaštitu podataka sa bilo kakvim pitanjima ili sugestijama vezanim za zaštitu podataka.

4) Politika “kolačića”

Internet stranice Petite Genève Petrović koriste “kolačiće”. Kolačići su tekstualni fajlovi koji omogućavaju da sajt brže funkcioniše.

Mnogi internet sajtovi i serveri koriste kolačiće. Mnogi kolačići sadrže takozvani ID – to je jedinstveni identifikator “kolačića”. Sastoji se od niza karaktera pomoću kojih internet stranice i serveri mogu biti dodeljeni specifičnom internet pretraživaču u kom je “kolačić” skladišten. Ovo omogućuje posećenim internet stranicama i serverima da razlikuju individualne pretraživače subjekta od ostalih internet pretraživača koji sadrže druge “kolačiće”. Poseban internet pretraživač može biti prepoznat i identifikovan pomoću jedinstvenog ID-ja “kolačića”.

Kroz upotrebu “kolačića”, Petite Genève Petrović može obezbediti korisnicima ove internet stranice lakše korišćenje koje ne bi bilo moguće bez politike “kolačića”.

Preko “kolačića”, informacije i ponude na našoj internet stranici mogu biti optimizovane imajući korisnika u vidu. “Kolačići”, kao što je prethodno napomenuto, dozvoljavaju prepoznavanje korisnika internet stranice. Svrha ovog prepoznavanja je da bi se olakšalo korisnicima koričćenje internet stranice. Korisnik Internet stranice koja koristi “kolačiće”, npr. ne mora da unosi pristupne podatke svaki put kada pristupa internet stranici, jer je ovo omogućeno od strane sajta, i “kolačići” su dakle skladišteni na računaru samog korisnika. Još jedan primer su “kolačići” vezani za korpu na sajtu za online kupovine. Online shop pamti artikle koje je korisnik stavio u korpu preko “kolačića”.

Subjekat može, u bilo kom trenutku, promeniti podešavanje određenog internet pretraživača i tako deaktivirati postavljeno podešavanje “kolačića”. Dalje, već postavljeni “kolačići” se mogu izbrisati u bilo kom trenutku preko internet pretraživača ili drugih softverskih programa. Ovo je omogućeno u svim popularnim internet pretraživačima. Ukoliko subjekat deaktivira podešavanje “kolačića” u korišćenom internet pretraživaču, neće biti moguće u potpunosti koristiti sve funkcije naše internet stranice.

5) Prikupljanje opštih podataka i informacija

Internet stranica Petite Genève Petrović prikuplja niz opštih podataka i informacija kada subjekat ili automatski sistem pozove internet stranicu. Ovi opšti podaci i informacije se čuvaju u datotekama dnevnika servera. Prikupljeni podaci mogu biti (1) tipovi i verzije pretraživača koji se koriste, (2) operativni sistem koji koristi pristupni sistem, (3) veb lokacija preko koje pristupni sistem dostiže našu internet stranicu, (4) pod-vebsajtovi, (5) datum i vreme pristup internet lokaciji, (6) adresu internet protokola (IP adresa), (7) dobavljač Internet usluga za pristupni sistem i (8) bilo koji drugi slični podaci i informacije koje se mogu koristiti u slučaju napada na naš IT sistem.

Prilikom korišćenja ovih opštih podataka i informacija, Petite Genève Petrović ne donosi nikakve zaključke o subjektu. Umesto toga, ove informacije su potrebne da se (1) pravilno dostavi korisniku sadržaj našeg sajta, (2) optimizuje sadržaj naše internet stranice, kao i njegove reklame, (3) osigura dugoročna održivost našeg IT sistema i tehnologije veb sajta i (4) pruže neophodne informacije organima za sprovođenje zakona i krivično gonjenje u slučaju sajber napada. Zbog toga Petite Genève Petrović analizira anonimno prikupljene podatke i informacije statistički, s ciljem povećanja zaštite podataka i sigurnosti podataka naše kompanije, kao i da se osigura optimalan nivo zaštite za lične podatke koje obrađujemo. Anonimni podaci o datotekama dnevnika servera se čuvaju se odvojeno od svih ličnih podataka koje pruža subjekt podataka.

6) Registracija na našoj veb stranici

Subjekt podataka ima mogućnost da se registruje na veb stranici kontrolora sa naznakom ličnih podataka. Koji lični podaci se prenose na kontrolora određuje odgovarajući ulazni dijalog koji se koristi za registraciju. Lični podaci uneti od strane subjekta podataka prikupljaju se i čuvaju isključivo za internu upotrebu kontrolora i njegove potrebe. Kontrolor može zahtevati transfer na jedan ili više procesora (npr. Paket usluga) koji takođe koriste lične podatke u interne svrhe koji se mogu pripisati kontroloru.

Registrovanjem na veb stranici kontrolora, IP adresa (koju dodeljuje Internet provajder usluga (ISP) i koju koristi subjekt podataka), datum i vreme registracije se takođe skladište. Čuvanje ovih podataka se odvija u pozadini i to je jedini način da se spreči zloupotreba načih usluga i, ako je potrebno, da bude moguće istražiti izvršena krivična dela. Zbog toga je čuvanje ovih podataka neophodno kako bi se osigurao kontrolor. Ovi podaci se ne prenose na treće strane, osim ako postoji zakonska obaveza prenošenja podataka ili ako prenos služi cilju krivičnog gonjenja.

Registracija subjekta podataka, sa dobrovoljnom naznakom ličnih podataka, ima za cilj da omogući kontroloru da ponudi sadržaj ili usluge subjektu koji se mogu ponuditi samo registrovanim korisnicima zbog svoje prirode. Registrovana lica mogu slobodno menjati lične podatke navedene pri registraciji na bilo kom mestu ili da ih potpuno izbrišu iz skladišta kontrolora. Kontrolor će u svakom trenutku pružiti informacije na zahtev svakom subjektu podataka o tome koje lične podatke čuva o subjektu podataka. Pored toga, kontrolor će ispraviti ili izbrisati lične podatke na zahtev ili indikaciju subjekta podataka, ukoliko nema zakonskih obaveza skladištenja. Svi zaposleni su na raspolaganju subjektu podataka u tom pogledu kao kontakt osobe.

7) Pretplata na naš bilten

Na veb stranici KOMPANIJE, korisnicima se daje mogućnost da se pretplate na bilten naše kompanije. Ulazni dijalog koja se koristi za ovu svrhu određuje koji lični podaci se prenose, kao i kada je bilten naručen od strane kontrolora.

KOMPANIJA redovno informiše svoje klijente i poslovne partnere putem biltena o ponudi kompanije. Bilten kompanije može primiti subjekt ako (1) ima važeću e-mail adresu i (2) se registruje za dostavu biltena. E-mail potvrde će biti poslat na e-mail adresu koju je subjekt prvi put registrovao sa podacima za dostavu biltena, iz pravnih razloga, uz dvostruku potvrdu prijave. Ovaj konfirmacioni e-mail se koristi da bi se dokazalo da li je vlasnik e-mail adrese kao subjekt ovlašćen za prijem biltena.

Prilikom registracije za bilten, takođe čuvamo IP adresu računarskog sistema koju je dodelio Internet provajder usluga (ISP) i koju koristi subjekt u trenutku registracije, kao i datum i vreme registracije. Prikupljanje ovih podataka je neophodno radi razumevanja (moguće) zloupotrebe email adrese subjekta kasnije, i stoga služi cilju pravne zaštite kontrolora.

Lični podaci prikupljeni u trenutku registracije za bilten će se koristiti samo za slanje biltena. Pored toga, pretplatnici na bilten mogu biti obavešteni elektronskom poštom, sve dok je to neophodno za rad usluge ili u slučaju registracije, pošto bi ovo bilo moguće u slučaju izmena ponude biltena, ili u slučaju promene tehničkih okolnosti. Neće biti prenosa ličnih podataka trećim stranama. Pretplata na naše biltene može biti ukinuta od strane subjekta podataka u bilo koje vreme. Saglasnost za skladištenje ličnih podataka, koju je subjekt podneo za dostavu biltena može biti poništena u bilo koje vreme. Za svrhu ukidanja saglasnosti, u svakom biltenu se nalazi odgovarajući link. To je takođe je moguće uraditi u bilo koje vreme direktno na veb stranici kontrolora, ili komunicirati kontroloru na drugi način.

8) Praćenje biltena

Bilten Petite Genève Petrović sadrži takozvane Piksele praćenja. Piksel za praćenje je minijaturna grafika ugrađena u takvim e-mailovima, koji se šalju u HTML formatu kako bi se omogućilo snimanje i analiza dnevnika. Ovo omogućava statističku analizu uspeha ili neuspeha marketinških kampanja. Na osnovu ugrađenog piksela praćenja, Petite Genève Petrović može videti da li i kada je subjekt e-poruke otvorio e-poštu i koje su veze (linkovi) u e-mailu bile pozvane od strane subjekta.

Takvi lični podaci prikupljeni pikselima koji su sadržani u biltenima se čuvaju i analiziraju od strane kontrolora kako bi se optimizovala isporuka biltena, kao i da se sadržaj budućih biltena prilagođava bolje interesima subjekta podataka. Ovi lični podaci neće biti prosleđeni trećim licima. Subjekti u svako doba imaju pravo da oduzmu odgovarajuću deklaraciju o pristanku koja se izdaje uz dvostruku potvrdu prijave. Nakon opoziva, ovi lični podaci će biti izbrisani od strane kontrolora. Petite Genève Petrović automatski smatra povlačenje iz primanja biltena kao opoziv.

9) Mogućnost kontaktiranja preko veb stranice

Na veb stranici Petite Genève Petrović nalaze se informacije koje omogućavaju brz elektronski kontakt sa našom kompanijom kao i direktnu komunikaciju sa nama, koja takođe uključuje i opštu adresu takozvane elektronske pošte (e-mail adresa). Ukoliko subjekt podataka kontaktira kontrolora putem e-maila ili putem kontakt formulara, lični podaci koji se prenose od strane subjekta podataka se automatski čuvaju. Takvi lični podaci koji se dobrovoljno prenose od strane subjekta podataka kontroloru podataka se čuvaju u svrhu obrade ili kontakta sa subjektom podataka. Nema prenosa ovih ličnih podataka trećim licima.

10) Rutinsko brisanje i blokiranje ličnih podataka

Kontrolor podataka obrađuje i čuva lične podatke subjekta podataka samo tokom vremena koje je potrebno da se dostigne svrha skladištenja, ili u vremenu koje odobrava evropski zakonodavac ili drugi zakonodavci u zakonima ili propisima kojima kontrolor podleže.

Ako se svrha skladištenja ne primenjuje ili ako je rok za skladištenje propisan od strane evropskog zakonodavca ili drugog istaknutog nadležnog zakonodavca, lični podaci se rutinski blokiraju ili brišu u skladu sa zakonskim zahtevima.

11) Prava subjekta podataka

a) Pravo na potvrdu

Svaki subjekt podataka ima pravo odobreno od evropskog zakonodavca da dobije od kontrolora potvrdu o tome da li se lični podaci koji se tiču njega obrađuju ili ne. Ukoliko subjekt želi da iskoristi ovo pravo na potvrdu, on ili ona može, u bilo koje doba, kontaktirati bilo kog zaposlenog u kompaniji kontrolora.

b) Pravo pristupa

Svaki subjekt podataka ima pravo koje je evropski zakonodavac odobrio da dobije od kontrolora besplatno informaciju o njegovim ili njenim ličnim podacima koji se čuvaju kao i kopiju ove informacije. Osim toga, Evropske direktive i propisi omogućavaju subjektu podataka pristup sledećim informacijama:

• svrha obrade; 

• kategorije ličnih podataka; 

• primaoci ili kategorije primalaca kojima su lični podaci bili ili će biti otkriveni, posebno primaoci u trećim zemljama ili međunarodnim organizacijama; 

• gde je to moguće, predviđeni period za koji će biti skladišteni lični podaci, ili, ako je moguće, kriterijume koji se koriste za određivanje tog perioda; 

• postojanje prava da se zatraži ispravljanje ili brisanje ličnih podataka, ili ograničavanje obrade ličnih podataka u vezi sa subjektom podataka ili suprotstavljanje takvoj obradi; 

• postojanje prava da podnesu žalbu nadležnom organu; 

• kada se lični podaci ne prikupljaju od subjekata podataka, sve dostupne informacije o izvoru podataka; 

• postojanje automatskog odlučivanja, uključujući profilisanje, navedeno u članu 22 (1) i (4) GDPR-a i, barem u tim slučajevima, značajne informacije o logici koja je uključena, kao i značaj i predviđene posledice takve obrade za subjekte podataka.

Pored toga, subjekt podataka ima pravo da dobije informacije o tome da li su lični podaci prebačeni u treću zemlju ili nekoj međunarodnoj organizaciji. Tamo gde je to slučaj, subjekat podataka će imati pravo da bude obavešten o odgovarajućim zaštitnim sredstvima vezanim za prenos.

Ako osoba na koje se odnosi podatak želi da iskoristi ovo pravo pristupa, on ili ona može u bilo koje vreme kontaktirati bilo kog zaposlenog u kompaniji kontrolora.

c) Pravo na ispravku

Svaki subjekt podataka ima pravo koje je evropski zakonodavac odobrio da dobije od kontrolora, bez nepotrebnog odlaganja, mogućnost ispravljanja netačnih ličnih podataka koji se odnose na njega ili nju. Uzimajući u obzir u svrhu obrade, subjekti imaju pravo da završe nekompletne lične podatke, uz pružanje dodatne izjave.

Ako subjekt podataka želi da iskoristi ovo pravo na ispravku, on ili ona može, u bilo kom trenutku, kontaktirati bilo kog zaposlenog kontrolora.

d) Pravo na brisanje (pravo da se zaboravi)

Svaki subjekt podataka ima pravo koje je evropski zakonodavac odobrio da dobije od kontrolora, bez nepotrebnog odlaganja, mogućnost brisanja ličnih podataka koji se odnose na njega ili nju, a Kontrolor će imati obavezu brisanja ličnih podataka bez nepotrebnog odlaganja, ako se primenjuje jedan od sledećih razloga, sve dok obrada nije neophodna:

• Lični podaci više nisu potrebni u odnosu na svrhu za koju su bili sakupljeni ili na drugi način obrađeni. 

• Subjekt podataka povlači saglasnost na osnovu koje se obrada temelji na tački (a) Člana 6 (1) GDPR-a, ili tački (a) člana 9 (2) GDPR-a, i gde ne postoji druga zakonska osnova za obradu. 

• Subjekt podataka se protivi obradi u skladu sa članom 21 (1) GDPR-a i nema nadležnog legitimnog osnova za obradu, ili se predmet podataka protivi procesuiranju u skladu sa članom 21 (2) GDPR. 

• Lični podaci su nezakonito obrađeni. 

• Lični podaci moraju biti izbrisani zbog poštovanja pravne obaveze zakona Unije ili zakona Države Članice u čijoj nadležnosti je kontrolor. 

• Lični podaci su prikupljeni u odnosu na ponudu usluga informacionog društva navedenog u članu 8 (1) GDPR-a.

Ako se primeni jedan od gore navedenih razloga, a subjekt podataka želi da zatraži brisanje ličnih podataka čuvanih od strane Petite Genève Petrović, on ili ona može, u bilo kom trenutku, kontaktirati bilo kog zaposlenog kontrolora. Službenik Petite Genève Petrović će brzo osigurati da se zahtev za brisanje odmah ispuni. Ukoliko je kontrolor objavio lične podatke, obavezan je u skladu sa članom 17 (1) da obriše lične podatke, uzimajući u obzir dostupnu tehnologiju i troškove implementacije, preduzeće razumne korake, uključujući tehničke mere, da obavesti druge kontrolore koji obrađuju lične podatke da je subjekt podataka zatražio brisanje podataka, ili njihovo kopiranje ili replikaciju ličnih podataka, ukoliko se obrada ne zahteva. Zaposleni kompanije će organizovati potrebne mere u pojedinačnim slučajevima.

e) Pravo ograničenja obrade

Svaki subjekt podataka ima pravo koje je evropski zakonodavac odobrio da dobije od kontrolora ograničenje obrade ako se primenjuje jedno od sledećih tački:

• Tačnost ličnih podataka osporava se od strane subjekta podataka, u periodu koji omogućuje kontroloru da proveri tačnost ličnih podataka. 

• Obrada je nezakonita, a subjekt podataka se suprotstavlja brisanju ličnih podataka i umesto toga zahteva ograničenje njihove upotrebe. 

• Kontroloru više ne trebaju lični podaci u svrhu obrade, ali su potrebni subjektu u cilju uspostavljanja, vršenja ili odbrane pravnih zahteva. 

• Subjekt podataka je uložio prigovor na obradu u skladu sa članom 21 (1) GDPR-a, uz dodatnu potvrdu i proveru da li se legitimni razlozi kontrolora preklapaju sa razlozima subjekta podataka. 

• Ako je ispunjen jedan od gore pomenutih uslova, a subjekt podataka želi da zatraži ograničenje obrade ličnih podataka koje čuva KOMPANIJA, on ili ona može u bilo kom trenutku kontaktirati bilo kog službenika kontrolora. Zaposleni KOMPANIJE će ugovoriti ograničenje obrade.

f) Pravo prenosa podataka

Svaki subjekt podataka ima pravo odobreno od strane evropskog zakonodavca, da dobije lične podatke koji se odnose na njega ili nju, koji su dostavljeni kontroloru, u strukturiranom, najčešće korišćenom i merljivom formatu. On ili ona će imati pravo da prenesu te podatke drugom kontroloru bez prepreke od strane kontrolora kom su lični podaci prvobitno dostavljeni, sve dok je procesiranje zasnovano na saglasnosti u skladu sa tačkom (a) člana 6 (1) GDPR-a ili tačkom (a) člana 9 (2) GDPR-a, ili na osnovu ugovora u skladu sa tačkom (b) člana 6 (1) GDPR-a, a obrada se vrši automatizovano znači, sve dok obrada nije neophodna za obavljanje zadatka koji se obavlja u javnosti interesa ili u vršenju službenog ovlašćenja koja je dato kontroloru.

Osim toga, u ostvarivanju svog prava na prenos podataka u skladu sa članom 20 (1) GDPR, subjekt ima pravo da prenese lične podatke direktno od jednog kontrolora ka drugom, gde je tehnički izvodljivo i kada to ne utiče na prava i slobode drugih. Da bi se utvrdilo pravo prenosa podataka, subjekt podataka može u bilo kom trenutku kontaktirati bilo kog zaposlenog u Petite Genève Petrović.

g) Pravo na prigovor

Svaki subjekt podataka ima pravo koje je evropski zakonodavac odobrio da podnese prigovor na osnovu njegove ili njene posebne situacije, u bilo kom trenutku, na obradu ličnih podataka koji se tiču njega ili nje, na čemu se zasniva tačka (e) ili (f) člana 6 (1) GDPR. Ovo se odnosi i na profilisanje na osnovu ovih odredaba. Petite Genève Petrović neće više obrađivati lične podatke u slučaju prigovora, osim ako ne omogućimo ubedljive legitimne osnove za obradu koje nadjačavaju interese, prava i slobode subjekta podataka ili je to potrebno za slučaj uspostavljanja, vršenja ili odbrane zakonskih zahteva.

Ako Petite Genève Petrović obrađuje lične podatke u cilju direktnog marketinga, subjekt podataka ima pravo da se u bilo koje vreme protivi obradi ličnih podataka koji se odnose na njega ili nju za takav marketing. Ovo se odnosi na profilisanje u meri u kojoj se odnosi na takav direktni marketing. Ako subjekt uloži prigovor za obradu za potrebe direktnog marketinga, Petite Genève Petrović neće više obrađivati lične podatke u ove svrhe. Pored toga, subjekat podataka ima pravo, na osnovu razloga koji se odnose na njegovu ili njenu konkretnu situaciju, da se suprotstavi obradi ličnih podataka od strane Petite Genève Petrović za svrhu naučnog ili istorijskog ili statističkog istraživanja koji se odnose na njega ili nju u skladu sa članom 89 (1) GDPR-a, osim ako je obrada neophodna za obavljanje zadatka koji se vrši iz razloga od javnog interesa.

Da bi ostvario pravo na prigovor, osoba sa podacima može kontaktirati bilo kog zaposlenog u KOMPANIJI. Pored toga, subjekt podataka je slobodan u kontekstu korišćenja usluga informacionog društva i bez obzira na Direktivu 2002/58 / EC, da iskoristi svoje pravo da uloži prigovor automatskim sredstvima koristeći tehničke specifikacije.

h) Automatsko individualno donošenje odluka, uključujući profilisanje

Svaki subjekt podataka ima pravo odobreno od strane evropskog zakonodavca da ne bude predmet odluke bazirane isključivo na automatskoj obradi, uključujući i profilisanje, koja stvara pravne učinke koji se odnose na njega ili nju, ili na sličan način značajno utiče na njega ili nju, sve dok odluka (1) nije neophodna za ulazak, ili izvršenje ugovora između subjekta podataka i kontrolora podataka, ili (2) nije odobreno od strane Unije ili Zakona država članica pod čijom nadležnosti je Kontrolor i koji takođe propisuje odgovarajuće mere za zaštitu prava i slobode i legitimne interese subjekta podataka, ili (3) nije zasnovan na eksplicitnoj saglasnoti subjekta podataka.
